The title of the article (translated from Japanese) is “The importance of and practical issues concerning initial investigations and internal investigations when corporate misconduct occurs”. It is the second of a two-part series based upon the reports that were presented at an internal governance seminar that Yoshihiro appeared at as a panel member, and which addressed the topic of “Initial investigations and internal investigations when corporate misconduct occurs: How do you make the starting point of your response to misconduct function properly?”

This article addresses the importance and fundamental elements of initial and internal investigations into corporate misconduct, and discusses the issues that arise in practice, including examples of poor responses.
